Current Status
On October 24, 2006, our firm filed a lawsuit against Waiting Angels Adoption Services in Macomb Michigan on behalf of five families. The families have all been victims of fraud, misrepresentation and various violations of Federal laws. In March 2007, one additional family joined the lawsuit and another joined in June of 2008 for a total of seven (7) families.

On May 8th, 2008, Joe Beauvais and Simone Boraggina plead no contest to Tax Evasion and were formally sentenced to 3 years probation. Currently it is a felony charge and if they satisfy ALL the terms of probation after 11 months it will be reviewed by the court (March 9, 2009) and the charges may become misdemeanors. They both must be employed 30 hours per week and pay various court fees during the 3 years of probation. They cannot be in the adoption business during this 3 year period or it is a violation of the probation.
The Michigan Attorney General's Office and the Michigan State Police have had hundred of hours into this case. Unlike investigations in other states, the Michigan Attorney General did not just make an announcement, allow the agency to close it's door and walk away. Michigan is the only state thus far who has prosecuted agency directors for this activity. We applaud their efforts.

How is this case different from the Michigan Attorney General's case against Waiting Angels?
Many of the same allegations are made in both cases but the Attorney General's case is a criminal case where Joe Beauvais and Simone Boraggina can go to prison. In the civil case, we can only ask for money for damages.
What happens now?
7/2010: The civil case was partially dismissed in the U.S. District Court - Western District Michigan. We have appealed the judicial decision and the case is pending before the 6th Court of Appeals.
